I would highly recommend the Law Firm of Ichter Thomas for lender related legal issues.  Our fledgling hotel project which due to business circumstances beyond our control (a GC breach of a guaranteed maximum price contract, economic recession, and lender seized by FDIC) was facing a bankruptcy and the managing partners were threatened with personal guarantees from the lender.

Within days of Cary Ichter’s review our files, we had a solid defense against our personal guarantees and were building a lender liability case against the bank.  Cary’s expertise in contract law and specifically lender documents were key to a successful outcome at a receivership hearing.  This hearing ended with the Judge ruling against the bank after only a cross examination of the lender’s representative and before we presented our defense.

This successful ruling with our receiver hearing resulted in a court ordered mandatory mediation with the lender to restructure our note.  Cary was able to accomplish in one hearing what we were unable to do with the lender two (2) years of effort that included over forty four (44) email requests, five (5) unanswered proposals, two (2) meetings and numerous phone calls.
